In consideration for the Participant being permitted to participate in one or more Events, the undersigned, as a parent or legal guardian (referred to in this document as the Guardian) of Participant, who is a minor (and who is referred to herein as the “Participant”) authorizes Participant to participate in any and all activities and events  (including transportation to and from such events, all of which are referred to as “Events”) which are sponsored or organized, in whole or in part, by St. Johns Presbyterian Church of Jacksonville, Florida, Inc. (hereinafter referred to as the Church). 


 


This Release and Waiver of Liability (hereafter referred to as the Release) is valid for the one-year term commencing on the date signed.  Participant shall not participate in any Events after that term without signing another Church Release and Waiver of Liability for the subsequent period.  If, however, Participant does participate in an Event more than a year after the date of this Release without providing a separate signed Release and Waiver of Liability for the time of that Event, the provisions of this Release shall be deemed to be extended to apply to injuries and damage connected with the Event in question.  In other words, this Release may continue to apply to Church Events that Participant takes part in, even after the year mentioned above. 



Guardian agrees with Church, on his/her own behalf, and on behalf of the Participant, and his or her or their respective heirs, devises and legal representatives, that the Guardian accepts and assumes any and all risks, and releases the Church from liability, and waives all causes of action against the Church, arising from or related to the Participant’s involvement with, or participation in, or injury or property damage resulting in connection with, any and all Events.


 


Without limiting the generality of the foregoing, Guardian hereby releases the Church and its respective officers, directors, employees and agents, from any and all liability, regardless of how it arises, whether seen or unforeseen, which is associated in any way with the Participant’s involvement with or participation in Events.  Furthermore, the Guardian agrees to indemnify, defend and hold the Church harmless from any and all claims, demands, expenses and/or liability caused by or suffered by the Participant or in way arising out of or related to the Participant’s involvement with, or participation in, Events.


 


This Release releases the Church and waives liability against the Church for claims that arise based upon the negligent actions or omissions of the Church and its respective officers, directors, employees, agents, chaperones and volunteers, with respect to Events and to injuries or damages associated with the Participant’s involvement with or participation in Events (including, but not limited to, the Church negligently training, organizing, hiring, retaining, or supervising anyone, including the Participant, other children, chaperones, Church employees, Church agents or representatives, or other third parties preceding and during Events).


             


The Participant may incur personal injury or property damage while participating in Events.  The Guardian authorizes medical treatment (including First Aid, as well as administration of pain relief such as Tylenol, aspirin or Advil) of the Participant by Church representatives or medical personnel in the event of injury which, in the reasonable opinion of the medical personnel or Church representative may be necessary or beneficial to avoid increased risk of endangerment to the Participant’s life, disfigurement, physical impairment, further complications or undue pain or discomfort.  This authority is granted with the expectation that the Church will make reasonable attempts to contact the Guardian and keep the Guardian apprised of all medical care in the event of an injury to Participant.  Guardian hereby designates the Church and its adult representatives involved in any Event as the Participant’s health care surrogate, including for purposes of granting informed consent to medical treatment.


 


If any court determines that any provision of this Release and Waiver of Liability, or any part thereof, is illegal or unenforceable, the remainder of this Release and Waiver of Liability or such provision shall continue to be in effect and the remaining provisions construed so as to limit, to the greatest extent allowed, the liability of Church and its representatives in connection with Events.  This Release may only be modified in in writing and approved by both the Guardian and the Church.  Whenever required by the context, the singular shall include the plural and the plural shall include the singular.


 


The Guardian acknowledges that he/she has reviewed this Release and Waiver of Liability, and completely understands and accepts all provisions hereof, and will indemnify, defend and hold the church harmless for misstatements by the guardian.  Guardian further represents and warrants that guardian is the parent or legal guardian of the Participant, and has full authority to execute this Release in favor of the Church.
